1. Introduction

These Terms and Conditions set out the basis on which Niran Advocates provides pension legal services to clients. By engaging our services or submitting an enquiry through our website at niranadx.info, you acknowledge that you have read and understood these terms.

2. About Niran Advocates

Niran Advocates is a legal practice registered in Thailand and a member of the Lawyers Council of Thailand. Our practice focuses on pension entitlement disputes and administrative review proceedings. We act solely for the client who has engaged us and do not accept instructions that create a conflict with an existing client's interests.

Our principal office is at 47 Asoke Montri Road, Khlong Toei Nuea, Watthana, Bangkok 10110. Office hours are Monday to Friday 09:00–17:30 and Saturday 09:00–13:00. The practice is closed on Sundays and Thai public holidays.

3. Services and Scope of Engagement

We offer the following pension legal services. Each engagement covers only the work described below for the fee stated. Any work falling outside the scope described will be discussed with you before it is undertaken and will be subject to a separate written agreement.

Service 01 — Pension Calculation Audit: We review the client's pension calculation year by year, compare entries against employment records, and produce a written reconciliation report. The report is provided to the client for review and approval before it forms the basis of any communication with the pension authority.

Service 02 — Back-Payment Recovery: We compile the documentary record for the period concerned, draft a formal claim for back-payment, correspond with the pension authority through the administrative phase, and produce a written report on the outcome. Where the authority partially accepts a claim, the implications are explained in writing so the client may decide whether to pursue the remaining balance.

Service 03 — Comprehensive Pension Restoration: We reconstruct the underlying pension calculation in writing, prepare the documentary record, draft all submissions, represent the client in correspondence and at hearings, and report to the client throughout. Each significant decision is referred to the client in writing before it is taken.

4. How an Engagement Begins

An engagement begins when we issue a written letter of engagement setting out the service to be provided, the fixed fee, and any specific terms applicable to the matter. We ask you to read the letter carefully and to confirm in writing that you wish to proceed on those terms.

Submitting an enquiry through our website or making a telephone call does not by itself constitute the commencement of an engagement and does not create a legal services relationship. No work will be carried out on your matter until the letter of engagement has been confirmed.

5. Fees and Payment

The fees listed in Section 3 are fixed fees covering the full scope of work described. They are stated in Thai Baht and are inclusive of VAT where applicable. No additional fees will be charged for work falling within the stated scope.

Payment is due on confirmation of the letter of engagement, prior to commencement of work. We accept bank transfer to the account details provided in the letter of engagement. A receipt will be issued on receipt of cleared funds.

Out-of-pocket disbursements — such as official fees charged by the pension authority, court filing fees, or translation costs — are not included in the fixed fee and will be discussed with you before they are incurred. You will not be committed to any disbursement without your written agreement.

6. Your Responsibilities

To allow us to carry out the agreed service effectively, we ask that you:

We will always explain the reason for any request and the timeframe within which a response is needed. If a particular deadline is tight, we will say so clearly and without pressure.

7. Confidentiality

We maintain strict confidentiality in respect of all client information and documents. Information relating to your matter will not be disclosed to any person outside the practice without your written consent, except where we are required to do so by law or by professional conduct obligations imposed on us as registered legal practitioners in Thailand.

We ask you to keep confidential any written advice, analysis, or strategy documents we provide to you, which are prepared for your use in connection with the specific matter only.

8. Limits of Our Responsibility

We carry out our work with care and in accordance with professional standards. However, the outcome of a pension claim or administrative proceeding depends on factors including the position of the pension authority, the documentary record available, and the applicable regulations, none of which are within our control.

We do not make representations about the likely outcome of any matter, and no statement made by any member of the practice during a consultation, telephone call, or in correspondence should be read as a commitment to a particular result.

Our liability to you in connection with a matter is limited to the fee paid for that matter, except in cases of fraud or wilful misconduct on our part. This limitation is set at the level of our professional indemnity insurance and does not affect your statutory rights.

9. Ending an Engagement

You may end an engagement at any time by writing to us. If you do so before any substantive work has commenced, we will refund the fee in full within fourteen days. If work has commenced, we will retain a portion of the fee proportionate to the work completed and refund the balance.

We may withdraw from an engagement in the limited circumstances permitted by professional conduct rules, including if we receive instructions that would require us to act contrary to law, or if we are unable to reach you over a sustained period and there is a risk that a deadline will be missed. We will give you as much notice as circumstances allow and will return all documents in our possession.

On conclusion or termination of an engagement, we will return original documents to you. We will retain copies of our working papers and the file correspondence as required under professional conduct obligations.

10. If You Are Dissatisfied

We take any concern about our service seriously and ask that you raise it with us at the earliest opportunity. You may write to the principal, Niran Thawatchai, at [email protected] or at our office address. We will acknowledge your concern within five working days and respond substantively within twenty working days.

If your concern is not resolved to your satisfaction through our internal process, you may refer the matter to the Lawyers Council of Thailand, which oversees the professional conduct of registered legal practitioners.

11. Governing Law

These Terms and Conditions and any engagement entered into under them are governed by the laws of Thailand. Any dispute arising in connection with them is subject to the jurisdiction of the Thai courts.

12. Changes to These Terms

We may update these Terms and Conditions from time to time, for example to reflect changes in professional conduct requirements or applicable law. Any changes will be published on this page with an updated date. The terms that apply to a specific engagement are those in force at the time the letter of engagement is confirmed.
